CLAIM FOR COMMUNAL RESERVATION UNDER SOCIALLY AND EDUCATIONALLY BACKWARD CLASSES (SEBC)

Guidlines

Note: Reservation to Socially and Educationally Backward Classes will be in accordance with the provisions contained in GO (P) No.208/66/Edn. dated 02.05.1966 and GO (Ms) No. 95/08/SCSTDD Dated 06.10.08 and as amended from time to time. [See Annexure IV for the list of communities under SEBC]

(i) Candidates belonging to SEBC as per GO (P) No.208/66/Edn. dated 02.05.1966, GO (Ms) No.95/08/SCSTDD dated 06.10.08, GO (Ms) No.09/2009/SCSTDD dated 24.01.2009 and whose annual family income (i.e. Annual income of all members in the family from all sources taken together) does not exceed Rs. 4.5 Lakhs (Rupees Four Lakhs fifty thousand only) are eligible for reservation under this item.

(ii) Candidates claiming reservation under SEBC quota such as Ezhava, Muslim, Other Backward Hindus, Latin Catholic other than Anglo Indian, Other Backward Christians and Kudumbi should produce both Community and Income certificates obtained from the concerned Village Officer/Tahsildar.

(iii) Applicants claiming reservation under Latin Catholic other than Anglo Indian quota should produce a community certificate from the concerned Village Officer/Tahsildar specifying that they belong to Latin Catholic other than Anglo Indian community.

(iv) Children of inter-caste married couple claiming communal reservation under SEBC should furnish an ‘inter-caste marriage certificate’ from the Village Officer/Tahsildar. Such candidates can avail themselves of communal reservation under any one of the communities of their parents, to be mentioned by the candidate in the relevant column of the application. They need not produce the income certificate.

(v) Candidates who are children of Inter-caste married couple of which one is SC/ST who will be eligible for educational and monetary benefits admissible to SC/ST as per Section 2 (ii) of GO (MS) No.25/2005/SCSTDD dated 20-06-2005, if eligible for reservation under SEBC, will be granted the same based on the community shown in the inter-caste marriage certificate issued by Revenue officials and to be attached by them with the application.

ANNEXURE – V

FOR ADMISSION AGAINST SEATS RESERVED FOR STATE MERIT (KERALA)
Candidate should be an Indian citizen of Kerala origin.

In order to prove that a candidate is an Indian citizen of Kerala origin for the limited purpose of eligibility for admission, he/she has to produce any one of the following certificates (a / b /c) or true copies of documents mentioned in any one of the following in (d / e / f )


(a) In the case of candidates who have undergone school studies in Kerala, a course certificate from the Head of the Educational Institution(s) in Kerala, to prove that the candidate has undergone his/her studies in Kerala for not less than 5 (five) years within a period of 12 (twelve) years, immediately prior to the completion of the Higher Secondary or equivalent examination.

OR

(b) A certificate from the Village Officer/ Tahsildar to show that he/she or his/her mother/father was born in Kerala.

OR

(c) Certificate from the Village Officer/Tahsildar to the effect that the candidate has been a resident of Kerala State for a period of five years within a period of twelve years


OR


(d) The true copy of relevant page of Secondary School Leaving Certificate of the Candidate showing the place of birth in Kerala

OR

(e) The true copy of the relevant page of the Secondary School Leaving Certificate showing Place of Birth in Kerala of either of the parents of the candidate with corroborative certificate to establish the relationship between the parent and the candidate



OR

(f) The true copy of the relevant page of the Passport of the Candidate issued by the Government of India, showing Place of Birth in Kerala or of either of the parents of the candidate showing Place of Birth in Kerala with corroborative certificate to establish the relationship between the parent and the candidate.

OTHER GENERAL RULES FOR MANDATORY RESERVATION

(i) The seats un-availed of by the Scheduled Castes candidates will go to the Scheduled Tribes candidates and vice versa.
(ii) The seats un-availed of by the SC/ST candidates will be filled by Other Eligible Community (OEC) candidates [See Annexure III for the list of OEC]. The seats that still remain un-availed will go to the State Merit (Kerala). OEC will be eligible for reservation only if their annual family income from all sources is up to Rs. 4.5 lakhs [GO (Ms) No.9/2009/SCSTDD dated 24.01.2009]. Such candidates should furnish income certificate obtained from the Village Officer/Tahasildar.

1) Form : Non-Creamy Layer Certificate - 1

Non-Creamy Layer Certificate: The Creamy layers are not eligible for the privileges reserved for the backward classes. If the purpose for which caste certificate is required for specifically requires mention of non-creamy layer, the same is issued by the VO (for State Govt. purpose) and by Tahsildar (for Central Govt. purpose). An applicant whose family income exceeds Rs 4.5 Lakhs cannot avail privileges reserved for OBCs and as such falls in the creamy layer. The income of only the parents is considered for purpose of exclusion as non-creamy layer. Children of Class I employees and Constitutional members cannot be issued non-creamy layer certificate.

Process inputs for non creamy layer certificates are

In case of Govt. Employees: Employment certificate from employer
Category of Post employed in
Income proof (property details, income from all other sources)

N.B: For Govt. employed Parents with Agriculture income only income by salary is not considered.

The particulars verified for issuing a non creamy layer certificate are caste, income, nativity and employer certificate of the applicant.

For SIUC: Certificate from Bishop

Adopted Children: Proof of Caste of father and adoption.

Hi Anil,

This is Hari. Yesterday in a post i had asked you whether i can get NCL certificate as my father working in BSNL Group C and mother in PWD Group B, combined salaries exceeding 4.5.
You mentioned i can get.

I am currently residing in Coimbatore since i was born, but i have OBC certificate from Kerala, Palghat. When i spoke to a retd Tashildar he said if the total income exceeds 4.5, they aren going to give NCL here in Tamilnadu. He thinks it will be the same in kerala as well.

In that case, what should i do if they say they have executive orders to reject if the family income exceeds 4.5. My IIM admission and few other MBA college admissions rely heavily on NC .

you are Non Creamy layer.

“Income limit criteria” is not applied to sons and daughters of persons in Government service and also sons and daughters of persons holding equivalent or comparable posts in PSUs, Banks, Insurance Organisations, Universities, etc.

Para 3

The criteria prescribed for determining creamy layer status of sons and daughters of persons in Government service mutatis mutandis applies to the sons and daughters of persons holding equivalent or comparable posts in PSUs, Banks, Insurance Organisations, Universities, etc and also holding equivalent or comparable posts and positions under private employment.

Income from the salaries and income from the agricultural land shall not be taken into account. It means that if income from salaries of the parents of any candidate is more than Rs.4.5 lakh per annum, income from agricultural land is more than Rs.4.5 lakh per annum, but income from other sources (business) is less than Rs.4.5 lakh per annum, the candidate shall not be treated to be falling in creamy layer on the basis of Income/Wealth Test.

Para 4

Clause (x) of Para 4 What is the scope of the explanation, 'Income salaries or agricultural land shall not be
clubbed', given below the Income/ Wealth Test?

Ans. Para 10. In regard to clause (x) of para 4, it is clarified that while applying the Income/Wealth Test to determine creamy layer status of any candidate as given in Category-VI of the Schedule to the OM, income from the salaries and income from the agricultural land shall not be taken into account It means that if income from salaries of the parents of any candidate is more than Rs.4.5 lath per annum, income from agricultural land is more than Rs 4 5 latch per annum, but income from other sources is less than Rs 4 5 latch per annum, the candidate shall not be treated to be falling in creamy layer on the basis of Income/Wealth Test provided his parent(s) do not possess
wealth above the exemption limit as prescribed in the Wealth Tax Act for a period of three consecutive years.

Dear Sirs,

The eligible OBC candidates are not getting caste certificate due to misinterpretation of creamy layer criteria Dt. 08.09.1993, especially in case of sons/daughters of government servants.

NORMALLY AN OBC CANDIDATE HAVING PARENT’S SALARY INCOME ABOVE Rs. 4.50 LAKH DONT TRIES TO GET OBC NON-CREAMYLAYER CASTE CERTIFICATE, WHICH IS A TOTALLY WRONG CONCEPT.

In creamy-layer criteria issued by Ministry of Personnel (DOPT) Government of India New Delhi vide O.M. No.36012/22/93-Est. (SCT) dated 8.9.1993 (also adopted by Supreme Court in recent judgment on Civil writ petition no. 265/2006 of 27% obc reservation in Central higher educational institutions) following important point is misinterpreted due to which whole country is confused including OBCs and authorities issuing the caste certificate.

(1) Actually the annual income limit of Rs. 4.50 lakhs is not applicable to “government servant’s salary income” & “farmer’s agricultural income”. It is the limit for “business income” only.

(2) In rule- (6) showing the creamy-layer annual income criteria of Rs.4.50 lakhs following
explanation is already given:

“Income from salaries or agricultural land shall not be clubbed with total income”

It means that income from salaries and agricultural land both will not be added with the annual income because to determine creamy layer status there are separate rule number

(2) & (3) provided on the basis of “post held” for salaried persons & rule number (5) of “land holdings” for persons holding agricultural land. Hence they cannot be checked by salary/agricultural income.

(3) The criterion (2) & (3) clearly speaks that only the sons and daughter of following “government servants” will be treated as creamy-layer.

(i) Parents, either of whom is a Class I officer. (Direct Recruitment)
(ii) Parents, both of whom are Class II officers. (Direct Recruitment)
(iii) Parents of whom only the father is a Class II officer and he gets into Class I at the age of 40 or earlier.
(iv) In military, colonel and above.

“Other than the above 4, all the government servants are not creamy-layer.”

(4) The criteria (5) clearly speak that only following “farmers” will be treated as creamy-layer. (i) Having, only irrigated land which is equal to or more than 85% of the statuary ceiling area. (ii) The rule of exclusion will not apply if the land holding of a family is exclusively un-irrigated.

A very clear creamy layer clarification regarding not to include salary and agricultural income vide DOPT O.M. dated 14 October 2004 Para-10, is also available on website WWW.OBCGURU.COM.
