|
As per central govt creamy layer criteria dated 08.09.1993 “For whole life of a candidate (son or daughter) only parent’s income or status is considered to determine creamy layer status?"
(1) The creamy layer status of a married woman will be always determined by her parent’s (father, mother) status/income. For which please go through the explanation No.(b) of Rule II (A) of creamy layer criteria DT 08.09.1993- Provided that the rule of exclusion shall not apply in the following cases :- (b) A lady belonging to OBC category has got married to a Class I officer, and may herself like to apply for job. (2) Each clause of creamy layer criteria DT 08.09.1993 says that “SONS & DAUGHTERS OF SO & SO.............................................” will be treated as creamy layer. Means that candidate’s creamy layer status is always determined by parent’s (father, mother) status/income (3) Para 08 of creamy clarifications DT 14.10.04 issued by DOPT GoI clearly speaks that: - “8. Creamy layer status of a candidate is determined on the basis of the status of his parents and not on the basis of his own status or income or on the basis of status or income or on the basis or status or income of his/her spouse. Therefore, while determining the creamy layer status of a person the status or the income of the candidate himself or of his/her spouse shall not be taken into account. (4) Candidate’s creamy layer status is always determined by parent’s (father, mother) status and never by status of self, husband, or spouse. Hence, candidate’s creamy layer status will be determined only by his parent’s (father, mother) status and his income will never be counted. . (5) “This reservation facility is actually based on that “what status a father-mother (parent) has given to a child since his/her birth”.” (6) EVEN THERE IS NO NEED TO LEAVE THE JOB FOR A CANDIDATE TO BECOME A NON-CREAMY LAYER FOR RESERVATION. (7) CREAMY LAYER STATUS OF A CROREPATI CANDIDATE IS DETERMINED BY HIS PARENTS STATUS/INCOME. (8) Even if a person has been selected for the post of IPS through, UPSC Civil Services Examination and he want to appear again in same the examination to become an IAS he is still a non-creamy layer candidate based on his PARENTS STATUS/INCOME and can avail the OBC reservation again. (9) If you go through the “application format to get OBC certificate,” http://persmin.gov.in/WriteData/CircularNotification/ScanDocument/Estt(Reservation)/Compendium.pdf you will find that they have only asked to mention the status of Father & Mother even not of husband.
