02 strict conditions of voluntary migrated SC-ST from one state to another for eligibility of SC-STs facility.


CONDITIONS

(1) There is a cutoff date of 1950 (i.e. the date of declaration of caste list of SC-STs) regarding inter state voluntary migration of SC-STs.

(2) The caste should be available spellingwise in new state.

 

If a person or his family members wants to get SC-ST caste certificate & reservation facility from state A, where they are presently residing due voluntary migration they have to prove that they had been migrated in this state A before 1950 otherwise they are not entitled to get SC-ST caste certificate & reservation facility from state A & they have to apply in general. 



Even if Maharashtra cadre is allotted to an IAS officer resident of UP against his preference, his sons and daughters are not eligible to get reservation in Maharashtra.



Even if a SC person of Maharashtra gets marry with a SC woman of Gujarat of same caste after 1950 the SC woman (wife) is not entitled to get SC reservation in Maharashtra.

However, the original state cannot refuse to issue caste certificate to a son or grandson even though he has born in other state.



SIMILARLY, DIFFERENT STATES HAS FIXED DIFFERENT CUTOFF DATES FOR VOLUNTARY MIGRATION OF OBCs.



Like MP has fixed this date 26.12.1984 (i.e. the date of declaration of caste list of OBCs by Mp State govt).



Even if you marry with a OBC woman of Maharashtra of same caste after 26.12.1984 the OBC woman (wife) is not entitled to get OBC reservation in MP like for teacher ship, UG/PG admission etc.



The basic theme behind it is every state has declared the facilities of reservations, scholarships or loans etc for their own OBCs and not for the migrants.



Now answer to your questions-

(1) Person A can avail the reservation facility of State A if he fulfill the above two conditions.

(2) Person A can get state OBC Caste certificate from State A if he fulfill the above two conditions. However, he can get Central OBC certificate from state A based on documents brought from state B.

(3) He can get caste certificate from state B & state B cannot refuse to issue caste certificate. People are getting such certificate easily. Requirements can be known from local authorities it may vary from place to place.

(4) State B cannot refuse to issue caste certificate as you might have gone through the SC-ST migration condition of 1950.




Kindly do not give answer to all OBCs that “there is a singe rule of Rs. 4.50 lakhs per year for creamy layer & candidate's income is counted.” (Please go through the attachment.)
