Open Letter to The Supreme Court as a response to the PIL filed on OBC Reservation

Dear Sir,

Sub: Open Letter to The Supreme Court regarding PILs on OBC Reservations.
The Writ Petitions dated May 26, 2006; Nos.265 and 269 of 2006
by Mr. Shiv Khera & Advocate Mr. Ashok Kumar. 
  1. According to the leading newspaper reports dated 30th May 2006, the vacation bench of the Supreme Court (SC) has admitted the above-mentioned PILs opposing OBC Reservation Policy on Monday 29, 2006.
  2. We, in the form of several independent socio-cultural-educational organizations of the members from OBCs fear that our constitutional rights safeguarding our interests are likely to be compromised. We therefore, have formed an action committee viz. “Arakshan Bachav Samitee (ABS) (Save Reservation Committee)” to educate and organize OBC masses.
    Some of our OBC members are:

    c.    125    Parit, Dhobi    (Launderer)
    d.    169    Agri, Agale    (Salt Men)
    e.    170    Bhavsar    (Textile Process Artisan)

    g.    181    Teli        (Oil Extractor)
    h.    182    Mali        (Gardner, Vegetable/Flower Grower)
    i.    187    Bhandari    (Distillers, Liquor Merchant, Cooks)
    j.    201    Gavit/Gabit    (Fisher men)
    k.    236    Darji        (Tailor)

  3. We therefore, would like to make this representation in the form of “Open Letter” before the Supreme Court Bench, which will be hearing the PILs. This representation will help the court in understanding some of the issues and pain areas, so that our constitutional rights are not compromised.

  4. This Open Letter has 5 sections:
    1.    Introduction.
    1.1.    PILs regarding OBC Reservation.
    1.2.    Arakshan Bachav Samitee (Save Reservation Committee).
    1.3.    Our Sincere Plea.
    2.       Broad Overview of the OBC Reservation.
    2.1.    Brief History of OBC Reservations by Mandal Commission (MC).
    2.2.    Brief Chronology.
    3.       Derogatory, Humiliating & Insulting Comments about SC/ST/OBC in Media.
    3.1.    “IT’S APARTHEID”!
    4.       The Latest Significant Events.
    4.1.    Medicos Agitation “Event Managed” with Huge Investment.
    4.2.    Current Events.
    5.       Monitor the Status of Backward Castes.
    5.1.    Repeated Obstacles.
    5.2.    Objective Model.
    5.3.    Parameters or Dimensions.
    5.4.    Maintenance of Model.

    Section 1.3 is our plea in the form of questions, which are haunting us as a consequence of the medicos’ anti-reservation agitation, media propaganda, and the proceedings in the SC related to PILs and medicos’ strike.
    Sections 2 is mainly factual historical details about Reservation for Backwards.
    Section 3 & 4 contains the relevant excerpts from newspapers.
    Section 5 contains the description of computation to create the Index of Backwardness.

  5. As a convener of the ABS, I have circulated this “Open Letter to Supreme Court” to ABS braches as well as OBC caste organizations/associations at Tahasil / District level with a request to discuss it amongst the members to obtain their agreement and then forward it to SC as their endorsement for this representation. You may therefore receive multiple copies of this “Open Letter” from multiple sources.
  6. This is to request you to put up this document before the Hon’bl judge/s hearing these PILs. Please let me know, if you need any other detail or clarification.

PS: Originally this letter was to be submitted on August 1, 2006. However, as GoI gave indication of resolving the issue through an Act of Parliament, ABS decided to wait and watch. Unfortunately, despite the unanimous decision of Parliament, SC has once again stayed the affirmative program which is systematically and deliberately delayed since 1947. It also appears that GoI is not bringing all the facts before the SC bench. Therefore, as ABS Convener I would like to submit this letter for your consideration.
